VA – The managing company of a Hilton Garden Inn will pay $675,000 to a female housekeeper who was assaulted in a hotel room by her male co-worker. The man was a registered sex offender. The suit alleged that the hotel manager was aware of the offender’s history and should have warned his employees who they were working with.
VA – A University of Virginia whistleblower has won $820,000 in a federal lawsuit. The suit alleged that the researcher was fired after reporting to authorities that his supervisor altered an NIH grant. The supervisor changed the amount of time lab staff worked on the project, thus altering what percentage of the grant money would go to staff members. The suit was filed under both the False Claims Act and the Whistle Blower Protection Act. The NIH declined to investigate the matter when it was informed about the grant changes.
NY – An Ithaca jury has awarded a police officer $2M in a federal suit. The officer brought the suit for $19M, claiming that he faced discrimination when he was denied a promotion because he was white. His charges of racial discrimination were dismissed, but the jury found that the city retaliated against the officer after he filed legal action.
NY – A federal jury has awarded a female ex-prison guard $650,000 and an additional $250,000 in attorney’s fees for a sexual harassment case. The harassment began during state training, when she was given a booklet titled “Orientation Handbook for Female Staff Working in an Institutional Setting.” The male officers were not given copies, and the book was discontinued for use in training after a newspaper reported on the case. The suit alleged that the sexual harassment continued over a period of five years, between four prisons. During that time, the Plaintiff was continually subjected to unwanted touches and false rumors by her co-workers.
IL – Northern Illinois Flight Center will pay $500,000 to an illegally terminated pilot. The U.S. Department of Labor’s Occupational Safety and Health Administration found that the center violated whistleblower protections provisions. The pilot had been asked to falsify documents for the certification of another pilot, and was terminated after contacting authorities about violations of the pilot certification process. The OSHA has ordered the center to reinstate the employee.
IL – A federal jury has awarded a woman $100K in compensation for a lawsuit which alleged she was retaliated against by the Madison County Regional Office of Education. There was a salary discrepancy between the complainant and her male counterpart and after reporting it, the woman was excluded from meetings and luncheons. While the jury ruled that the Office did not violate the Equal Pay Act or discriminate by gender, it did award money for a retaliation claim.
NY – Family Dollar Stores will settle a class action law suit for $14 million dollars. The suit stemmed from the executive exemptions provision in the Fair Labor Standards Act. The suit was brought by over 1,700 NY state store managers who were improperly labeled executive, and so were found to have lost overtime wages. If the court finds that an employee does not meet the exceptions, the company can owe back overtime pay to employees. The qualifications for executive exemption include the primary duty of management and the supervision of at least two full-time employees. If the executive exemption is met, stores are not liable for unpaid overtime wages.
CA – A former ‘Price is Right’ model has won a pregnancy discrimination lawsuit against the show. Jurors awarded the woman $777,000 in the first phase of the trial. The suit alleged that the game show’s producer barred her from returning to work after taking maternity leave. A second phase of the trial will determine whether the former model will be awarded punitive damages; her attorneys are seeking an additional $8 million.Topics: Jury Verdicts
