Stakes Rise In Worker Classification Dispute

The Alaska Employment Law Blog has a post today on a Wall Street Journal article about Blackwater's independent contractor squabble with the House Oversight Committee.  CNN also reports on Rep. Henry Waxman's demand for information from Blackwater and his allegation that the company had avoided millions of dollars in taxes by misclassifying workers.  The stakes continue to rise in the worker classification debate. EEOC Releases Fact Sheet On Employment Tests And Selection Procedures

The EEOC released a fact sheet today on employment tests and selection procedures.  It "provides technical assistance on some common issues relating to the federal anti-discrimination laws and the use of tests and other selection procedures in the employment process" and lists a number of "employer best practices" recommended by the EEOC.  The fact sheet also sets out several cases filed by the EEOC as illustrative of their position on screening practices. Should We Expect New FMLA Regulations?

According to Workplace Prof Blog there will be no new FMLA regulations anytime soon.  WPB tenders a prediction that a Democratic administration in 2008 might result in paid leave provisions being added to the FMLA.  On the other hand, employers and other groups such as the Heritage Foundation, advocate for changes in the regulations with respect to medical certification and intermittent leave. Checking Out Job Applicants On The Internet

Thanksgiving dinner brought out a number of interesting anecdotes about the practice by employers of screening job applicants based on their Facebook or MySpace pages.  Apparently it is now common for hiring managers to review social networking sites of applicants to see whether they "fit" the department's culture.  One article cites a 2006 CareerBuilder.com survey as reporting that 26% of hiring managers ran an internet search on applicants while only 12% checked social networking sites.  Re...
